The Death Penalty Is A Valued Part Of Our Judicial System

â€Å"Why I believe the death penalty is a valued part of our judicial system† Although the death penalty is opposed by many people, I believe capital punishment is a necessary and valued part of the judicial system for numerous reasons such as the ultimate warning message, the costs involved, and the morality of the punishment. The first reason that the death penalty is a valued part of our justice system is the notion that it serves as the ultimate warning message towards people considering crimes such as murder, or any other crime for that matter. Knowing the United States court system will not hesitate to put convicted murderers to death this would incline these would be murderers to think twice about their actions. The major reason put forward in favor and preference of love marriages was hat marriage is a relationship which is deemed to be for entire life and if the person who is going to be the life partner is the one whom you know from earlier and have a good understanding with then life will go on smoothly. Most of the people were of the opinion that the perfect age for marrying would be between 25 years to 29 years as by that time the person is well settled in his financial and social life and is mature enough to take the decisions which are going to affect him or her in the long run. On the question Of parents disapproval from the partner which One chooses most of he people agreed on the condition that they will try to persuade their parent and tell them the gravity of feelings they both have with each other and also will put forward the point that how well their life can go if the person they are marring is the same person they love. Also agreeing that fiftieth parents do not like something they will sort out with mutual consent concluding that ultimately parents will agree. Very few almost 1 out of 10 said that they will dc according to their parents wish. All of the people who were surveyed agreed on the point of remarriage of widow/widower or divorced, putting forward an argument that the person who has undergone such situation too has a right to live life happily and its the feelings that matter at the end not the tag. On the question of responsibilities related to the children the answers were based upon the gender of the person to who was answering the question, most of the males gave a response that the duty and responsibilities are more inclined towards the mothers whereas the females were of the opinion that both mother and father share equal responsibilities. On the question of polygamy and polyandry people interviewed shared a common feeling that such system should not be promoted and should be fully criminality. There was a common consensus seen among the people on question of remaining a bachelor, with an argument that it is solely upon the person that he wants to marry or not, if he wants to lead a single life he has all the liberties to do so. Same was the opinion with remarrying the old age people, most of the person interviewed were of the opinion that if there are two person who are old and alone and want to be married then they should do so, let the social stigma attached with this not affect their lives and its an onus upon us to move stigmas like this. CONCLUSIONS The study revealed the following perceptions of youth on the different points of consideration adopted in the survey. The majority, conforming to the modern notion of love and family life, chose love marriage over arrange marriage. A larger portion of the youth were observed supporting the requisite of planning and settlement before marriage, and deeming maturity and sense of responsibility to be an imperative for the development of a good married life. When challenged by a predicament in which they had to choose between their newly founded love and their loving parents, the latter was awaken as a reference while deciding the important question of life. On widow remarriage, the dogma which defined this practice as a taboo in the 19th century was seen completely absent in the mindsets of todays growing youth. They could even be portrayed as the proponents of this revival in thought. Even the same was seen with the question on marrying the person who has been divorced. Diverse views were obtained on the question whether a father, or a mother, who was more responsible towards the caretakers of the child, with a good number of people opining the need for both parents. The subject of polygamy and polyandry faced severe criticisms.

This results in an ever increasing workload that must be maintained or reconfigured; resulting in challenges to organizational profitability. One of the challenges that arises is how does an administrator maintain a complex work environment when increased profits, fewer capital and operating resources are limited. One might suggest growing a complex network infrastructure requires operation efficiency with a desire to manage and protect cables without interrupting the workflow for clients. However, given the challenges affecting wireless service providers; maintaining focus and quality are just the fundamentals. The administrator is limited to the organizations profitability and cost variance when determining the best approach. These factors play a role which will likely affect the infrastructure as a whole. It is interesting enough to point out that towards the perspective of a network administrator; an issue should remain dormant and should never happen when the proper implications are set in place. However, because we live in an intractable world the possibility for a scenario is plausible. Capstone Proposal Summary As a volunteer for a network security survey for Aon Corp; the following survey was designed to point out vulnerabilities within the organizational network servers specifically under the surety office location where class mates using workstations were experiencing frustrating issues pertaining to network instability. The survey was intended to identify on whether security implications were required so that an upgrade request may be delivered. A staff meeting was set in place where we  interviewed the client regarding their needs. It is always a good choice to understand the fundamental needs of the client prior to making any changes to the network. After spending several hours brainstorming the client’s demands a solution has been reached. The project setting has been laid out clearly. During my timeframe interviewing the client I have gained the necessary background knowledge to understand my client’s visions building a strong mutual connection. Understanding this connection has entitled me to diagnose the network accordingly. As a part of the survey Aon Corp has several requirements prior to jumping into the project. First it was mandatory to inspect the minimum system requirements of the client machines. In the past latency issues have derived primarily to out of date hardware or device drivers as opposed to a security breach. It is always a wise choice to update these configurations while running the appropriate operating system updates which may all be contributing factors. During the prerequisite stage of the survey the required information is gathered to develop an effective network survey which would alleviate resource constraint. Rational Systems Analysis It is always a wise choice to research similar case studies that may provide beneficial information relating to similar scenarios. I have done as such building my understanding of these scenarios which has a given me some background to my clients concerns. Several user friendly applications have offered me assistance analyzing security loop holes. They are the Microsoft Baseline Security Analyzer (MBSA) and Windows Server Update Services (WSUS). With accordance to the Microsoft website; the Microsoft Baseline Security Analyzer is a user friendly tool emphasized for technicians with a focus on assisting medium sized businesses. The tool focuses on the security state of the network with accordance to Microsoft recommendations providing guidelines and support. The user may download Microsoft Baseline Security Analyzer (MBSA) from Microsoft.com as it is a well-known tool for all IT technicians. Once the tool has been successfully installed the administrator has the ability to scan multiple end users on the local network median. Upon completion of the scan the user is delivered a report highlighting potential threats along with missing updates. Some of these updates may include missing application patches, operations system  updates, and advised the user on whether a Windows firewall is running. MBSA has the ability to examine administrative accounts along with password policies. See Figure A for example. Figure A As technology advances, administrative technicians need to adjust to the challenges ahead. Microsoft Baseline Security Analyzer is a great tool to maintain the integrity of your network infrastructure. Scott Lowe (2004), a Microsoft Certified Systems Engineer, said the following regarding the Microsoft Baseline Security Analyzer: â€Å"Supporting a huge number of Microsoft applications, MBSA can serve you in two ways. First, it will help you keep your servers protected from problems; second, with powerful reporting capabilities, it can help you actually learn why you need to do the things that are suggested so you can make an educated decision as to whether something is an acceptable risk in your environment.† Project Goals and Objectives The objective towards the following project was to initiate a plan to upgrade Aon Corp network infrastructure alleviating latency issues better improving the efficiency and flow of data across the network median. A current unstable network prolonged business growth capacity making it difficult for end users to utilize resources effectively. Without the essential resources company growth was at a bottleneck. Breaking down the goals and objectives for the following project was essential in providing a remedy to the issue, they are as follows: Client must receive a current system image snapshot -Survey of a workstation must be documented -Survey of a server must be documented -Microsoft Baseline Security tool must be run saving each workstation along with the server A scheduled protocol plan must be provided articulating details for the client on overall performance and network stability. Client must be advised of a detailed schematic for preventative measures along with upkeep Client must be given an  instructional manual for managing updates related to the operating system and antivirus software Client must be given an estimate on productivity along with return of investment In order to present the deliverables to the client; a solid fundamental understanding of the clients requirements must be developed. Acquiring a background understanding is essential in order to understand the business process and what the client wants to achieve out of their network infrastructure. Without understanding the big picture the project would certainly fail. Pre-SurveyClientMeeting The goal and objective here was to initiate a meeting with the client to discuss the business orientation and the process relations to their workstations. The clients company being a training institution; certain software was required in order for the firm to achieve their business goals. The applications required minimum system specs in order to run efficiently. During the preliminary phase of the meeting the business model and goals were discussed. Operational hours were taken into consideration as a set schedule was established for performing the survey. As the meeting came to an end a survey schematic was brought to the client’s attention in order to calculate return on investment upon project completion (refer to Appendix 2). The success of the meeting was met and the first objective was complete. Upon the completion of the survey the client was provided with an executable plan laying out the details of the upgrade and preventative measures. However, the full execution will be help outside the Capstone; it will be the key highlight to the success of the business goals. Network Security Survey As a prerequisite to the survey several spreadsheets having been compiled for capturing images of data (refer to Appendix 3 along with Appendix 4). The first document entitles end user computers and second focuses on servers. As for the MBSA scans for each workstation; a thumb drive was used to save the results. Prior to beginning the survey an update was brought to my attention from the client that others may be working on these end-user machines as well. Because of my failure to follow through during the phone meeting advising of the time schedule, I needed to contact the  other administrators advising them of my presence. Fortunately, as I arrived at the designated project site there were many computers to survey. I began to survey the end-user machines not being surveyed. About 3 minutes elapsed for each workstation to survey; running Microsoft Baseline Security (MBSA) took about 11 minutes. Unfortunately, I have missed my goal of reaching the estimated number of computers being surveys as discussed in the preliminary meeting. The survey elapsed more time than I have predicted. On the other hand it was pleasant to know that the other administrators finished their portion of the project just in time before I got to them. Surveying the workstations went according to schedule, however, as I approached the servers several problems aroused. The list of passwords the client provided did not contain the correct characters as I attempted to log into the domain controller. The owner has left the building and was unable to achieve my goal with surveying the servers as planned thus leaving my network security survey incomplete. The following day the owner has been contacted and a scheduled return visit was planned. As the domain controller was surveyed; the security network part of the survey has been successfully completed. Despite the minor issues the survey went flawless; I would have followed through with the client more efficiently if the same scenario would have repeated itself. The desired goal has been achieved and a data image has been captured so the proposal upgrade can be finalized. Proposal Upgrade Preparation The upgrade proposal was designed to contain the following suggestions. Configuration of the Domain controller Configuration of the server Configuration of the workstation Suggestions for Malware/Antivirus Report for ROI Security guide for the end-user Timeline of Upgrade As assumptions defining the network configuration have been made. Unknowingly an assumption was made that the domain controller is established as the default gateway, DNS and DHCP server. I came to understand that their infrastructure was split into four subnets. ISA server was in between the  ISP acting as NAT, DNS, DHCP, and RRAS server. Logically understanding that their domain controller was their default gateway, DHCP, and DNS server; the services were contained on the internal network. Failing to understand the possibility of a network perimeter my assumptions were incorrect. Eventually I was able to complete each task item provided above; a presentation with the client would finalize this portion of the project. The task was completed, however, not within the desired timeframe. Presentation Proposal As the completion of the proposal has been achieved a client meeting has been scheduled. The agenda of the meeting is as follows: 1. Discussing survey results (network state) 2. Hardware discussion / software suggestions 3. Projected ROI and cost 4. Questions 5. Schedule implementation Despite the presentation lasting 2 hours it was a success. Proper planning along with a satisfying network survey were the predecessors leading to this success. The network survey went very smooth and efficient. The proposal was straight to the point and meaningful for the client. As the following goal completed and the deliverables presented to the client project completion has been achieved. Due to the clients satisfactions with the deliverables the project has moved forward to the next portion of the upgrade phase. Project Timeline The timeline of the project was compiled using a Gantt chart from the software Microsoft Office Project 2012. The project plan along with the details are listed in Figure B. As indicated in Figure B, the project time frame was expected to take 238 days.   Several areas took time constraint. First the network survey as previously indicated where I failed to follow through with the client after the preliminary phase of the meeting. This resulted in the client scheduling students on campus on the same timeframe as the survey. Fortunately, there  were enough end-user computers to perform the survey. In time the remainder of the students have left the building freeing up those workstations as well. Forgetting to get a confirmation of the amount of workstations at the preliminary meeting indivertibly resulted in my underestimation of the amount of time it would take to survey the total amount of workstations. The client password list for the domain controllers portrayed to be the only problem I have run into when performing the survey resulting in a setback. Because I have forgotten to request the following information from the client; the survey was setback from the estimated time for completion; resulting in a day setback. Compiling the proposal was another task that was miscalculated. Fortunately, I was able to finalize the project in one day thus keeping the project within the constraints of the timeline. Client satisfaction was the ultimate goal as they were very grateful. It is expected that situations as such will not always go accordingly to plan; however, without the clients support the project would not have gone as smooth. Planning a larger margin while taking a less aggressive attitude at the preliminary meeting would have avoided such issues. Project Development During the preliminary development of the following project, Aon Corps network infrastructure was heading in an unknown direction pertaining to its economic success. Instabilities in their security policy, workstations were exponentially getting slower each day. Students along with testers were losing hope in the integrity of the company. Their mindset was affecting performance along with business profit opportunities. The project I was assigned to revolve around building a business by updating their network infrastructure to a level of efficiency. The concentration of the project focused on performing an upgrade solution that would provide this efficiency to the client. Original snapshots of the network were based in the upgrade proposal plan which was used to optimize the network. The optimal goal of the project was to implement a network infrastructure that would be secure. Just like all problems issues aroused during the progression of the project. Students were scheduled to be in the building at the time of the survey; a work around was developed as I was able to hinder another classroom. Upon completion of the workstations I was able to come back to the student’s  classroom which was cleared. Rearranging the order of the computers that have been surveyed the issue was concealed. Another situation that derived during development happened when I discovered that the client has given me the incorrect domain controller password list which did not contain the server administrative passwords. The lack of the following information would have definitely resulted in the project failing. Rescheduling the visit with the owner has alleviated this scenario. Unfortunately, because of the rescheduling the timeline has been pushed back preventing me from completing the project within the completion period. Anticipating that the network domain controller would be a configured as a default gateway. Assumptions were proven wrong and the configuration process to longer than expected. Due to an ISA server on the network perimeter changes to the configurations proposal had to be made. Creating an ROI report was another unanticipated event that was requested upon the client. Determining the monetary cost was difficult when comparing the proposed and current network conditions. Consequently, changes had to be made to the customer question business survey to assist me in these calculations. Gracefully, the client was able to agree upon these terms. Actual and Potential Effects Majority of the following section will focus on potential effects due to the project being a proposal. The project effects can be conceived by indicating that the client had a clear perspective towards the network infrastructure and how in its previous state it has manipulated business continuity. The client experienced the previous state and was provided with a schematic to the current stable state. Empowering the client with the details providing them with a clear understanding influenced them to take action thus changing their network infrastructure to one that works efficiently. The potential positives to the following plan are as follows. Should the client comply with the proposal providing the solution to their network; they will be rewarded with a network that is optimally configured. This will result in network operating efficiency and business processes will maintain its integrity. Less classroom interruptions will arouse related to workstation issues. Students taking tests will be less frustrated due to server crashes along with workstations. Customer  confidence in Aon corp will increase. The potential of business growth will result from the following project. There will be an ease of urgency related to network related issues. The organization can now focus on its business model focusing on their clients. Conclusion The capstone portrayed to be exciting yet challenging providing to be rewarding as well. In terms of goals and objectives I believe that it was successful. Client satisfaction has been achieved as each goal and object has been delivered. The reason why it was so successful and effective is due to the methodical planning prior to the initiation of the project. The necessity of preparation along with the preliminary client meetings has given me the fundamental understand on how to start building the project. Building a plan has given me an effective tool to deliver the clients expectations. Attention to detail along with effective communication were advantage points that designed an effective proposal. The client was efficient in being proactive by understanding the problem at point and expressing their concerns. Together a proposed plan has been derived that would act as a roadmap to that optimal network infrastructure. Flexibility and client patience played an important role during the hiccup moments of the project. The ability to determine alternative routes in an event of hitting a wall is essential to the success of any project. The Nature of Man, the Renaissance, and the Protestant Reformation Essa

Europe was a tumultuous region in the fifteenth and sixteenth centuries. In particular, the Renaissance and the Protestant Reformation both introduced radical intellectual and religious ideas that challenged centuries of established doctrine. This period corresponded with a great surge in philosophical, political, and religious writing. Among the most influential thinkers of the time were the Italian humanist Leon Battista Alberti, the Florentine politician Niccolà ² Machiavelli, and the German monk Martin Luther. Alberti wrote in a time of humanist thought and economic prosperity, Machiavelli in a time of growing political instability and economic uncertainty in Italy, and Luther in a time dominated by an increasingly corrupt Catholic church. While Alberti’s good fortune is reflected in On the Family’s optimism, Machiavelli’s The Prince and Luther’s On Christian Liberty are direct reactions to the perceived crises the authors were witnessing, and both works were written with an obvious sense of urgency. These writers all put forward strongly worded and drastically different views of the fundamental nature of man. Alberti saw man as an active being seeking a classical education and a good family in which to raise children, Machiavelli perceived man as craving power and impossible to satisfy, and for Luther man was eternally sinful searching only for faith in God. More significant than their visions of human nature is the physical focus of that nature—body or soul—and how the origin of such a attitude was related to the period in which they were living. While Alberti’s vision of human nature focused on a man’s outward actions shaping his inner soul, Luther saw just the opposite, a man’s soul struggling to achieve what... ...lberti saw a great potential for man and wanted to outline his vision for others. Machiavelli saw man’s flaws and what it caused, and sought only a cold, practical solution without the nuisance of morals. Luther, devastated by the corruption of the ruling religious authority, wished to save Europe’s Christians from a way of life that would seal their fate as sinners. Works Cited Alberti. Caribbean Literature Essay

The evolution of Caribbean Literature started centuries before the Europeans graced these shores and continues to develop today. Quite noticeably, it developed in a manner which transcended all language barriers and cultures. Today the languages of the Caribbean are rooted in that of the colonial powers – France, Britain, Spain and Holland – whose historical encounters are quite evident throughout the region. The cosmopolitan nature of the region’s language and cultural diversity develop from the mixture of European languages with Native American languages (mainly the Caribs and Arawaks) in the formation of creoles and local patois (hybrid languages) and those of Africans brought to the Caribbean as slaves, not withstanding the contributions of Asians mainly from India and China, and Middle Easterners. The fabric of Caribbean Literature is woven with the historical issues of enslavement and forced migration, the related themes of home and exile, and colonialism and decolonization. The social and cultural themes of tradition, landscape, culture and community are also encompassed by Caribbean Literature. It also addresses such universal questions as identity, sexuality, family life, pain, joy, and the uses of the imagination. It is virtually impossible to keep Caribbean Literature only within the confines of writings produced within the Caribbean Islands. Caribbean Literature also transcends the borders of Central and South America extending to the shores of Guyana, Suriname, French Guiana; and coastal areas of Colombia, Nicaragua, Belize and Honduras. Evidence of aspects of Caribbean Literature can also be seen in literary works produced in various areas of the USA including Miami and New Orleans. Works of Caribbean Literature have also been produced by people of Caribbean ancestry who live primarily in Europe and major urban centers of the United States. ORAL LITERATURE Oral literature can be considered as the earliest form of Caribbean Literature consisting mainly of rich folk- tale traditions, legends and  myths, songs and poetry. Today this legacy is resplendent in popular music such as the CALYPSO, the Cuban SON, and the Puerto Rican BOMBA; in the traditions of storytelling originating out of West Africa and India; and in supernatural tales from African religions, including SANTERIA, LUCUMI,VODUN (vodoo), and SHANGO. Proverbs, riddles, and sayings that reinterpret African, European, and East Indian traditions are also most prominent in Caribbean literature. Among these are Anancy (a cunning spider) stories; animal dilema tales, which typically teach a moral lesson; stories of village life or evil women; tall tales; and rhetorical flourishes, such as boasting, toasts, and speeches. PRE AND POST INDEPENDENCE LITERARY WORKS Autobiography and poetry were the most prevalent literary works from the 16th century to the mid – 19th century. In these works were introduced themes that became common in Caribbean literature; exile, migration, displacement and questions of identity. The history of Mary Prince, a West Indian Slave, (Related by Herself), is the most prominent of these writings in English. Early Caribbean writings in Spanish saw that of the autobiography of the slave Juan Francisco Manzano of Cuba in the 1820’s and 1830’s, Jose Maria Herida Placido ( a slave who was executed in1844 for his role in a slave uprising) and the Cuban anthropologist Miguel Barnet. Max Urena of the Dominican Republic produced nationalist works in the 19th century. The French speaking Caribbean saw works by Emeric Bergeaud and Desmevar Delorme. Distinct national literary traditions began in the 20thcentury because few Caribbean countries gained their independence before this period. Twentieth century Caribbean literature can be divided into three periods: the first thirty years during colonial rule; the years just prior to independence between the 1940’s and 1960’s or later, and the period after independence. During the fledgling years (1930’s) a movement celebrating African culture and values rose to prominence. The movement originated in France and was called NEGRITUDE. However, its founders include Leon Gontran Damas of French Guiana and Aime Cesaire of Martinique. Rene Maran of Martinique won the Prix Goncourt (a French literary prize) with the novel Batouala (1921) which called for identification with black culture. In the Spanish – speaking Caribbean African themes were presented in a most exotic manner, highlighting African and black identity for artistic inspiration. Prominent writers in this movement include Luis Pales Matos from Puerto Rico and Emillo Ballagas from Cuba. The works of Cuban poet Nicolas Guillen from the 1930’s share sentiments with the politics of NEGRITUDE and address issues surrounding the struggle against colonialism. Alejo Carpentier, also of Cuba, achieved recognition with his novels in which he explores the history and sources of Caribbean culture. The English – speaking Caribbean abounds with prominent writers including Jamaican novelist Tom Redcam (Thomas Macdermot), Claude Mckay, Jamaican born poet, and perhaps the best known writer of this generation internationally. Mckay later became one of the leading writers of Harlem Renaissance, a flowering black culture in New York in the 1920’s and 1930’s. Other writers who rose to prominence during this period are C. L. R. James of Trinidad, whose works protest against colonialism and help to define the anticolonial political and cultural struggles of his time. He was also instrumental in the formation of the literary magazines Trinidad (founded 1929) and the Beacon founded (1931); these publications were instrumental in the development of a Caribbean literary tradition. Alfred Mendes and Ralph de Boissiere (Trinidadians) both contributed articles and poetry to the magazines. PRE – INDEPENDENCE RENAISSANCE This period saw the emergence of a generation of writers whose works sought after liberation and presented a distinctive portrait of Caribbean culture. The Jamaican Vic Reid, looks forward to a â€Å"new day† of independence with his novel New Day (1949); the displaced, downtrodden, urban population of the Caribbean is portrayed by Roger Mais also of Jamaica. He also experiments with jazz rhythms in his language, while Una Mason, a Jamaican poet uses blues rhythm in her poetry collections. A vivid portrait of Guyana’s countryside and society is presented by Edgar Mittleholzer in his novel A Morning At The Office (1950). On the other hand, one of the first and most important Caribbean works dealing with childhood and coming of age in a colonial context was produced by George Lamming, from Barbados, in the novel â€Å"In The Castle Of My Skin† (1953). This novel focuses on the struggles of three young boys with poverty, a colonial education, social change and the forging of an identity; hovering in the background is the promise of migration to the metropolitan centers. The mythology of Native Americans and Africans is emphasized in Wilson Harris’s novel Palace of the Peacock (1960), while Martin Carter’s Poems of Resistance seek liberation from colonial rule. During this period a number of female writers were also very active. Beryl Gilroy of Guyana wrote novels, children’s stories, and an autobiography. Sylvia Wynter of Jamaica incorporates elements of folk culture into her work. From Dominica, Phyllis Shand Allfrey won recognition for her analysis of colonial power in her work, while Jean Rhys received critical acclaim for novels about women caught in situations they are unable to change. POST INDEPENDENCE This period saw the emergence of poets from the English – speaking Caribbean; Derek Walcott from Saint Lucia is perhaps the best-known Caribbean writer internationally. In 1992 he won the Nobel Prize for literature. In addition to poetry, Walcott is well known as a playwright. At the same time Eduard Kamau Brathwaite challenged the formal structures of European poetry by adopting the rhythms, references, and language of the African and Afro- Caribbean traditions. Brathwaite broadened the possible use of language in his works for a number of subsequent writers, including Jamaican oral poets Mutabaruka, Linton Quesi Johnson, and John Binta Breeze. Earl Lovelace and V. S. Naipaul count among other noted English – language writers born in Trinidad and Tobago. Naipaul received recognition for novels that focus on East Indians living in the Caribbean. Lovelace whose works won a Commonwealth prize wrote on issues of poverty, education, and village life. The French – speaking Caribbean saw prominent contemporary writers in Daniel Maxim of Guadeloupe and Edouard Glissant and Patrick Chamoiseau of Martinique. Chamoiseau explores issues of black identity, and creole cultural identity. The latter was produced along with Jean Bernabe and Rafael Confiant. Chamoiseau won the Pri Goncourt for his novel Texaco (1929). Noted female writers are Maryse Conde of Guadeloupe who is considered a significant voice among female writers, having won several French prizes for her literary work. Simone Schwarz -Bart, also of Guadeloupe, writes of the search for identity while Nancy Morejon of Cuba is recognized as a leading poetic voice. Her collection entitled Cuaderno de Granada 1984 (Grenada Notebook, 1984) honors those who participated in Grenada’s socialist revolution in 1983. Caribbean writers have impacted greatly on the international arena and have gained worldwide recognition for their numerous works. Literary critics are also recognizing the Caribbean roots of some African American writers who are explicit about their Caribbean parentage

Principles of diversity, equality and inclusion in adult social care settings Essay

Diversity – The concept of diversity is to encompass acceptance and respect. It means that each individual is unique and recognizing our individual’s differences, these can be along the dimensions of race, ethnicity, gender, social- economic status, age, physical abilities or religious beliefs. An example of diversity is to accept someone’s views even if you don’t agree Equality – Equality basically means access or provision of equal opportunities, where individuals are protected from being discriminated against. Equality can occur in race, sex, health, religion, family structure, age, disability or in terms of believes. An example of equality is not treating anyone different just because they have money or don’t and that everyone has the same changes if that be being prime minster or access to the same drugs or medications. Inclusion – the term inclusion is seen as a universal human right and aims at embracing all people irrespective of race, gender, disability, medical or other needs it is about giving equal access and opportunities and getting rid of discrimination and intolerance. Discrimination – discrimination is the equal treatment of individual. Usually on the basis of gender, race, age or disability. It is a negative action towards members of a specific social group. The effects can be physical, emotional or a combination of both. For example children with disabilities may not be given a chance to join in with activities due to others thinking that their disability prevents them from being able to do so. This will make the child feel very different from others. I have listed other possible effects below: * Feeling isolated * Low self-esteem * Depression * Fear of rejection * Stress * Low self-worth * Feeling withdrawn from society * Humiliation * Weight loss/ gain * Fear * Anger Long term effects may be: * Loss of motivation * Restricted opportunities * Limited access to services * Long term depression * Increased behaviour problems * Difficulty communicating * Lack of education * Lack of achievement The effects listed above are not only ones that affect the individual child/young person; they are effects that can be experienced by the individual’s family and friends too. The individual’s family can become isolated from society through trying to protect their family member and will often experience verbal abuse for having a family member that is perceived to be different. Family members can sometimes feel embarrassed about the shame the victimised individual brings to them and may distance themselves from the individual. Those who discriminate others often do so because they have been discriminated against themselves, are unhappy or because they have watched people close to them discriminate against others and are copying and responding to their actions. People that discriminate against others sometimes end up being isolated as many members of society disagree with it and make a stand against those who victimise others. If enough people challenge those who discriminate they may reconsider their views and actions. It can cause a split in society between those who go along with it and those who see it as an injustice. There will also be those (often the majority) who might not agree with it but don’t want to get involved – until it actually starts to affect their own lives. Practicing active participation – Active participation allows individual to realise their value and reduce isolation. Such a way an individual can gain self esteem which helps to reduce any form of abuse and discrimination. Quick and effective complaint procedure – Quick and serious effective complaint procedure helps to let individual to know that how seriously the act has taken and the consequences of discrimination. And it restrains people to engage in such act knowing the consequences of these acts. Meeting and discussion – It helps to increase awareness and carefulness to discriminatory acts. Also discussing and exercising this issue in day to day tasks help individual to challenge discrimination. Direct confrontation – this method can encourage the abuser to see and understand what they have done wrong this is more likely to promote change in their behaviour then leaving them unchallenged it would also send a message to others that discrimination is not accepted TASK B Legislation and codes of practice relating to diversity, equality, inclusion and discrimination Anti-discrimination Act 1977 The Anti-Discrimination Act 1977 is an Act of the Parliament relating to discrimination in employment, the public education system, delivery of goods and services, and other services such as banking, health care, and property and night clubs. The Act renders unlawful racial, sexual and other types of discrimination in certain circumstances and promotes equality of opportunity for all people. The Act covers the following types of discrimination: †¢ Sex (including breastfeeding, pregnancy and sexual harassment) †¢ Disability †¢ Race (including ethno-religion) †¢ Homosexuality (actual or perceived) †¢ Marital or domestic status †¢ Age (present or future) †¢ Transgender (including trans sexuality) †¢ Carer’s responsibilities (but only within employment). Racial discrimination act 1975 The Race Relations Act 1976 was established by the Parliament of the United Kingdom to prevent discrimination on the grounds of race. Items that are covered include discrimination on the grounds of race, colour, and nationality, ethnic and national origin in the fields of employment, the provision of goods and services, education and public functions. The Act also established the Commission for Racial Equality with a view to review the legislation, which was put in place to make sure the Act rules, were followed. The Act incorporates the earlier Race Relations Act 1965 and Race Relations Act 1968 and was later amended by the Race Relations (Amendment) Act 2000, notably including a statutory duty on public bodies to promote race equality, and to demonstrate that procedures to prevent race discrimination are effective. The Act was repealed by the Equality Act 2010, which supersedes and consolidates previous discrimination law in the UK The Equality Act 2010 The primary purpose of the Act is to codify the complicated and numerous array of Acts and Regulations, which formed the basis of anti-discrimination law in Great Britain. This was, primarily, the Equal Pay Act 1970, the Sex Discrimination Act 1975, the Race Relations Act 1976, the Disability Discrimination Act 1995 and three major statutory instruments protecting discrimination in employment on grounds of religion or belief, sexual orientation and age. This legislation has the same goals as the four major EU Equal Treatment Directives, whose provisions it mirrors and implements.[2] It requires equal treatment in access to employment as well as private and public services, regardless of the protected characteristics of age, disability, gender reassignment, marriage and civil partnership, race, religion or belief, sex, and sexual orientation. In the case of gender, there are special protections for pregnant women. However, the Act allows transsexual people to be barred from gender-specific services if that is â€Å"a proportionate means of achieving a legitimate aim†. [3] In the case of disability, employers and service providers are under a duty to make reasonable adjustments to their workplaces to overcome barriers experienced  by disabled people. In this regard, the Equality Act 2010 did not change the law. Under s.217, with limited exceptions the Act does not apply to Northern Ireland. The Mental Health act 1983 and 2007 amendments The 1983 Act is largely concerned with the circumstances in which a person with a mental illness can be provided with treatment without his or her consent. This is to ensure that people with serious mental illnesses can be treated where it is necessary to prevent them from harming themselves or others. Most people who receive psychiatric treatment in hospital are there on a voluntary basis and have the same rights as people receiving treatment for physical illnesses. However, a small number of people may need to be compulsorily detained under a section of the Mental Health Act. The Act explains who is involved in the decision about compulsory admission, the processes to be followed and the appeals and safeguards that are available to the patient and to their nearest relative. An application for compulsory admission must be supported in writing by two authorised practitioners. The recommendations must include a statement about why assessment or treatment is necessary and why other opt ions are not appropriate. People detained under the Act may have a right to apply to a Mental Health Review Tribunal to challenge their detention. Legal advocates are available to represent people at MHRTs and can be contacted at Sheffield Mental Health CAB From November 2008 new amendments to the 1983 Act were introduced. The following are the main changes to the Act: †¢ Introduces of the new role of Approved Mental Health Professional (AMHP) which replaces the Approved Social Worker (ASW). As well as social workers other professionals such as nurses, psychologists and occupational therapists can now be involved in compulsory admissions. †¢ Introduces of the Approved Clinician (AC) replacing the Responsible Medical Officer (RMO). T he RMO had to be a doctor, but the AC can now include other professions. †¢ Introduces a new ‘appropriate medical treatment’ test meaning that for a patient to be compulsorily detained there has to be appropriate medical treatment available to the patient. †¢ Gives patients the right to make an application to displace their nearest relative and appoint an alternative. †¢ Introduces Supervised Community Treatment (also known as Community Treatment Orders) for some patients following a period of detention in hospital. It will allow some patients to live in the  community whilst they continue with compulsory medical treatment. †¢ Introduces additional safeguards for patients by way of ‘Independent Mental Health Advocates’ who must be available for all patients who are detained. These are in addition to having a legal representative at a Mental Health Review Tribunal. It also reduces the time before a case can come before a Mental Health Review Tribunal. †¢ Introduces new safeguards for patients with regards to electro convulsive therapy (ECT). Carers (Equal Opportunities) Act 2004 The Carers (Equal Opportunities) Act 2004 (c 15) is an Act of the Parliament of the United Kingdom aimed at helping carers achieve fair access to training, work and leisure opportunities. It was introduced as a Private Member’s Bill by Dr. Hywel Francis and sponsored in the House of Lords by Lord Ashley of Stoke. 5.2 million People in England and Wales identified themselves in the 2001 Census as providing unpaid care to support family members, friends, neighbors or others because of long-term physical or mental ill-health, disability or old age. That represented nearly 10 per cent of the population and of those, 21 per cent (1.09 million) provided care for 50 or more hours per week. The Act requires assessments to be offered to carers, to consider the needs of carers in relation to leisure, education, training and work. Not all carers will wish to pursue all of these opportunities but practitioners completing assessments with the care should be able to signpost carers to other relevant agencies. Human Rights Act 1998 The Human Rights Act 1998 (c 42) is an Act of Parliament of the United Kingdom which received Royal Assent on 9 November 1998, and mostly came into force on 2 October 2000.[1] Its aim is to â€Å"give further effect† in UK law to the rights contained in the Convention for the Protection of Human Rights and Fundamental Freedoms, but more commonly known as the European Convention on Human Rights. The Act makes available in UK courts a remedy for breach of a Convention right, without the need to go to the European Court of Human Rights in Strasbourg. In particular, the Act makes it unlawful for any public body to act in a way which is incompatible with the Convention, unless the wording of any other primary legislation provides no other  choice. It also requires the judiciary (including tribunals) to take account of any decisions, judgment or opinion of the European Court of Human Rights, known as the Strasbourg court, and to interpret legislation, as far as possible, in a way which is compatible with Convention rights. However, if it is not possible to interpret an Act of Parliament so as to make it compatible with the Convention, the judges are not allowed to override it. All they can do is issue a declaration of incompatibility. This declaration does not affect the validity of the Act of Parliament: in that way, the Human Rights Act seeks to maintain the principle of Parliamentary sovereignty (see: Constitution of the United Kingdom). However, judges may strike down secondary legislation, so long as the legislation does not derive its power from primary legislation. Disability Discrimination Act 1995 The Disability Discrimination Act 1995 (c 50) (informally, and hereafter, the DDA) is an Act of the Parliament of the United Kingdom which has now been repealed and replaced by the Equality Act 2010 ([1]), except in Northern Ireland where the Act still applies. Formerly, it made it unlawful to discriminate against people in respect of their disabilities in relation to employment, the provision of goods and services, education and transport. The DDA is a civil rights law. Other countries use constitutional, social rights or criminal law to make similar provisions. The Equality and Human Rights Commission combats discrimination. Equivalent legislation exists in Northern Ireland, which is enforced by the Northern Ireland Equality Commission. It is still permissible for employers to have reasonable medical criteria for employment, and to expect adequate performance from all employees once any reasonable adjustments have been made. Explanation of the possible consequences for individuals, social care workers if the legislation and codes are not followed. An explanation of the possible consequences for individuals, care workers and others if the legislation and codes of practice are not followed. If this codes of practice and legislations where not to be followed the consequences can be diverse. They can affect just one individual or can affect an entire team of social care workers. By not following the codes of practice and the legislation you could cause a service user to feel discriminated against which would have negative effects such as making them feel isolated or un-heard and could  lead to more problems that would affect the people around them as well as the individual . By not using inclusive practice you may find that the S.U might be put in a situation in which they are not happy which could make them act out in a way that could affect their future and how other team members interact with them? Workers who realize the need for understanding, comprehending and respecting the needs of all patients, regardless of their diverse nature and background will be the most effective ones. Valuing the beliefs of others and keeping a wide ranging and accepting perception will aid considerably in the promotion of impartiality and equality. A community which is based on the fair rights of humanity realizes that consciousness, self-esteem, culture and physical and mental health are interrelated. In order to provide a balance in society the health care sector must be free of all prejudice and discriminatory practices. It also helps them to know about the consequences if agreed ways of working are not followed which restrain them from doing any form of  discrimination relating this issue. Task C My personal preferences, attitudes, heritage, and beliefs might impact on my working practice because I have to honor service users believes and other religion or non-religion. It is most important to remember that my own preferences are different to others and that I can never expect others to think, act or feel the same as I do about something for example I like to bath at night and have a shower in the morning but some of the service users have a fear of water and they really hate the idea of being showered, washed or baths even once a week. I have to respect their decision but at the same time I need to encourage them to maintain a health and clean state of mind and body, in cases like this I will spend more time encouraging the service user that they will feel better and not try and tell them how I feel when I am clean and fresh. It is important to understand that your attitude might have an impact on your working practice because your attitude can be broken down into a few things such as your mood, tone of your voice and your body language. So if one day you go into work in a bad mood and have an angry tone to your voice and your body language to match arms crossed etc. then the service user could feel intimidated, scared and uncooperative and less likely to do something that you ask them to do. Whereas if you go to work in a good and have a smile on your face and a cheery tone to your voice then the service user is more likely to be more cooperative and happier also it could put them in a better mood. Your heritage as a person could also have an impact on your working practice because if you have had a good caring up bringing or your parents have worked in the care industry then you would be more likely to understand what is required and a better understanding of the care sector. To ensure that your own practice is inclusive and respects the beliefs, culture, values and preferences of an individuals by knocking on the service users door asking them what they want to wear or what they wish to eat and if they go to church getting them ready even though I am not religious and you/I should also have a little understanding of a service users culture as it could make them feel more welcome and understand the service user better improving the quality of the  care that you give to that person. Mary is a 80 year old lady and before entering her room I would knock on the door and making sure that my mood, language, tone of voice, body language and approach are good and appropriate, Mary also likes to sit in her room watching TV however I like to encourage Mary to join in activates and events in the lounge so she interacts with others, Mary likes to chat and has questions so I like to chat and has questions so I like to take time to pay her attention and answer any questions she may have so that she feels listened too by listening to Mary’s ideas and concerns and taking onboard what she has said with also help make Mary more confident and by using some of Mary’s ideas may also help Mary feel more valued, by doing this will make Mary feel accepted and welcome. Types of practice that excludes an individual and that is also discriminatory is if you were to leave a service user in bed and not get them up washed and dressed or not allowing them to join in on act ivies another example is if you did not give a service user the pills that they needed therefor leaving the service un comfortable and maybe in pain also leaving them in their room with the TV on but the volume so low that the service user can’t hear the TV or if a service user is in a wheel chair and if they can’t get access to certain rooms or parts of the house, another example is if a service user is deaf and there is a meeting and they can’t join in or get their views across.
